It’s interesting to observe the Supreme Court after the leaked decision. All of the conservatives appointed to the court agreed that the right to an abortion was guaranteed to use the legal term “stare decisis.” It is Latin for “to stand by things decided,” or said another way, a judge is obligated to stand by prior precedents. It is actually a bit of trickery. The Supreme Court is not bound by prior precedents. They are free to do whatever they want. In this case, they appear to be rejecting the right to an abortion because it is not guaranteed in the Constitution. The arguments are usually a little more complicated than that. It is a right of privacy that was up for debate.

Did the justices lie during their confirmation hearings? Technically they did not. They used a legal term they knew did not apply to the Supreme Court. They did what all politicians do.
